Regulations of the MS Green game

Article 1: Game organisation

Arjowiggins Papiers Couchés, a company registered in the Commerce and Companies Register of Nanterre under the number 393 361 134, with its head office located at 32, avenue Pierre Grenier – 92100 Boulogne Billancourt – France, (the Organiser) is organising a competition (the Competition) without purchase obligation.

Article 2: Object of the game

In order to promote the MS GREEN range (Maine gloss Green and Satimat Green), the Organiser will allocate the prizes as per article 6 to the first respondents of the game as mentioned in article 5.

Participating in the Competition implies full acceptance by the participant of the current Regulations and any subsequent modification of these.

Access to the game

The competition is accessible by postal mail only.

Article 3: Dates and duration

This game will run from Monday 7th January 2013 to Tuesday 30th April 2013.

The Organiser reserves the option to extend the period of participation and to postpone any of the announced dates.

Article 4: Conditions of participation and validity

4-1: Participation

The Competition is restricted to recipients of the printed MS GREEN mailing in the following 8 countries = metropolitan France, Spain, Germany, Belgium, The Netherlands, Switzerland, Romania, Poland.

The following people may not enter the Competition: employees of the ‘Organiser’, their direct family members, employees or subcontractors.

4-2 Validity

All fields of the reply-card must be completed and validated.

Information regarding identity, address or professional capacity, or any other fields mentioned in the reply card that are found to be incorrect or incomplete will lead to the entry being annulled.

The Organizer reserves the right to eliminate entries that do not comply with the Regulations from the Free Prize Draw; for instance an incomplete or unreadable reply card.

Article 5: Declaring the winners

The prizes will be allocated on a first-come first-served basis: the first 20 participants in France, first 100 participants in Belgium, first 100 participants in The Netherlands, first 30 participants in Spain, first 170 participants in Germany, first 65 participants in Switzerland, first 30 participants in Poland and first 30 participants in Romania.

Any reply-card drawn that contains false or incorrect or incomplete information or that does not comply with the present Regulations, will be considered invalid, and another winner will be drawn.

Article 6: Prizes

Prizes will be allocated as follows: 545 gift voucher of high quality biological products. The spread between the countries is as follows : 20 winners in France (gift vouchers of 15€), 100 winners in Belgium (gift vouchers of 15€), 100 winners in The Netherlands (gift vouchers of 15€), 30 winners in Spain (gift vouchers of 15€), 170 winners in Germany (gift vouchers of 9,90€), 65 winners in Switzerland (gift vouchers of 20 CHF), 30 winners in Poland (gift vouchers of 15€) and 30 winners in Romania (gift vouchers of 15€).

Article 7: Publishing the names of the winners:

The winners’ name will be announced on the website www.arjowigginsgraphic.com.

Article 8: Prize delivery

Prizes will be sent to the postal address given by the participants.

Incorrect electronic address, incorrect postal address: (information by email)

If the postal or email address is incorrect or does not correspond to that of the winner, or if for any other technical reasons the information mail or email cannot be delivered to the correct recipient, the Organiser will under no circumstances be held responsible.  It is also not the responsibility of the Organiser to search for the addresses of winners that cannot be reached due to an invalid email address or incorrect postal address.

Unclaimed prizes: Winners who cannot be reached, or who do not reply within 7 days to provide their address, cannot claim any prize, compensation or indemnity of any sort.

Prizes that are attributed are personal and not transferable. Moreover, prizes can in no way be contested by the winners, nor be swapped or exchanged for any counterpart of any kind.

Article 9: Miscellaneous

Entrants authorise Arjowiggins Papiers Couchés in advance to use their names, brand names, logos, photographs and/or testimonies for commercial purposes, with no other compensation than the prize won.

Article 10: Data protection

In accordance with the Data Protection Law n° 78-17 of 6 January 1978 as amended, Entrants are informed that data specifying names collected during the COMPETITION will be processed in an electronic file. Entrants have the right to access, correct and delete data concerning them. This right can be exercised by sending a request in writing to the following address: Arjowiggins Papiers Couchés – 32, avenue Pierre Grenier – 92100 Boulogne Billancourt – France.

Article 11: Liability

Entrants acknowledge and accept that the sole obligation of the Organiser with regard to the Competition is to accept all entry forms into the draw; provided that their entry complies with the terms and conditions of the Regulations, and to provide the prizes to the winners, in accordance with the criteria and methods defined in these Regulations.

The Organiser cannot be held liable for - and this list is not exhaustive - any technical, hardware or software failure of any kind, risks of contamination from any viruses on the network and the lack of protection of certain data against misappropriation.

Entering the Competition implies knowing and accepting the characteristics and limitations of the Internet in terms of technical performance and response times for consulting, and for querying or transferring information.

It is expressly understood that in any event, if the liability of the company Arjowiggins Papiers Couchés is incurred, it may not exceed the amount of the prize won in the end by each winner.

Article 12: Case of force majeure / reservations

The Organiser cannot be held liable for any case of force majeure or independent occurance leading to the amendment, shortening or cancelation of the competition.

The organiser reserves authority of the Competition, whilst respecting the Regulations, in particular in order to rule out any incorrect, false or cheated entry.

 

Article 13: Complaints

The Regulations are governed by the French law. Any difficulty in application or interpretation of the Regulations will solely be fixed by the Organiser.

No enquiry or complaint will be answered by phone as regards of the application and interpretation of these Regulations. Any complaint must be sent exclusively in writing to the Competition address. Written disputes and complaints concerning the Competition shall not be taken into account until 8 days after the end of the Competition.

Arjowiggins Papiers Couchés will make every effort to settle out of court any dispute that might arise concerning the interpretation or implementation of these Regulations.

If there is permanent disagreement, French law and the Paris courts shall have sole jurisdiction.

Article 14: Reimbursement of expenses

Expenses incurred to enter the competition shall be reimbursed on request sent exclusively by mail to:

Reimbursement claims must be sent within a period of 30 days from the entry deadline, namely 13th May 2012. After this date, no claim will be taken into account.

Entrants may, if they so desire, ask for reimbursement of a second class stamp at the rate in force sending details of their bank or post office account with their written claim as well as proof from France Telecom, or another operator, certifying an actual connection, specifying the date and time of the connection.

Internet connection will be reimbursed in the form of postage stamps, at a rate of €0.34 incl. tax (i.e. 5 minutes of connection).

In the current state of service offers and technology, as some Internet providers offer users a free connection or for a fixed price, it is hereby expressly specified that any access to the site made without charge or on a fixed price basis (such as, in particular, cable, ADSL or special connections) may not give rise to any reimbursement, insofar as the subscription to the provider's services is in this case made by the Internet user for his general Internet usage and the connection to the Site to enter the competition did not incur any additional expense or outlay.

As entering the competition is strictly free and without obligation to purchase goods and services, reimbursement is made at the simple request of the competitor accompanied by the required documents (see hereafter) and the postage costs relating to the reimbursement claim:

- Bank or post office account details

- Photocopy of proof of identity (identity card or passport)

- Copy of the Internet provider's invoice specifying the date and time of the connection. This data will be checked and the Company will store the entry and exit dates and times.

Article 15: Deposit

The Regulations are deposited with SELARL AY, Eric ALBOU & Carolle YANA, Huissiers de Justice associés -32 rue de Malte – 75011 PARIS - France.
